Two member Judge Panel in Court of
Appeal comprising of it's chairman Preethi Padman Surasena and Arjuna Obeysekare had decided today (26)to take up a petition submitted by 122 MP's of Parliament requesting to issue a 'Quo Warranto " writ order to make the appointment of Premier Mahinda Rajapakshe and his Cabinet of Ministers "null and void",for hearing on 30th of November and 03 Rd of December .
The Petitioners have named 49 persons including the newly appointed Cabinet lead by Appointed Premier Mahinda Rajapakshe as respondents .
The Petition has stated that Premier Mahinda Rajapakshe does not have the support of Majority in Parliament and even the speaker has confirmed it .Therefore it requests the court to decide Premier Mahinda Rajaoakshe has no legal right to hold premiership according to the Constitution and issue a court order to make his appointment "null and void".
Notices are due to be issued to the respondents shortly it has Been revealed.
122 MP's belonging to political parties represent in Parliament including United National Party ,Tamil National Alliance, Sri Lanka Muslim Congress and Janatha Wimukthi Peramuna have signed the petition filed at Court of Appeal.
